BMR Compliance_When is a Benchmark Provider Not an AdministratorThe European Union’s Benchmarks Regulation (BMR) is intended to regulate the index industry—the provision of indices that are used as benchmarks—and correct weaknesses in the process by which indices are set.

Since many fund and asset managers select, calculate, and use benchmarks or rates determined by reference to an index, firms that have not traditionally considered themselves index providers are now questioning whether they might be considered benchmark providers (i.e., administrators) under the new law.
